These Terms & Conditions (“Terms”) govern your use of abbyirondoors.com and purchases of products or services from Abby Iron Doors (“Abby Iron Doors,” “we,” “us,” or “our”).
By using our website, requesting a quote, placing an order, or purchasing products or services, you agree to these Terms.
If you enter into a separate written quote, order agreement, sales contract, invoice, installation agreement, warranty, or other agreement with Abby Iron Doors, that agreement controls if it conflicts with these Terms.
1. Website Use & Product Information
You may use our website only for lawful purposes. You may not interfere with the website, attempt unauthorized access, copy or commercially exploit our content, submit fraudulent information, or use automated or harmful technologies against the website.
We make reasonable efforts to provide accurate product information, photographs, specifications, dimensions, availability, and pricing. However, website information may contain errors or change without notice.
Product images are representative. Actual colors, finishes, glass, textures, ironwork, materials, and handmade details may vary because of manufacturing processes, natural variation, lighting, photography, and screen settings. Images may also show optional features not included with a product.
2. Quotes, Orders & Custom Products
Quotes and website pricing are subject to final confirmation. Pricing may change if dimensions, specifications, materials, shipping, installation scope, site conditions, or other project requirements change.
Customers are responsible for reviewing and approving applicable drawings, dimensions, configuration, handing, swing direction, glass, finish, hardware preparation, and other specifications.
Once a custom order is approved and fabrication begins, it cannot be canceled or refunded, unless Abby Iron Doors agrees otherwise in writing.
Changes requested after approval may result in additional charges, delays, or may not be possible.
Abby Iron Doors may reject or cancel an order because of pricing errors, unavailable materials, payment issues, suspected fraud, manufacturing limitations, or other reasonable business circumstances.
3. Payment
Unless otherwise agreed in writing:
- In-stock products: Full payment is due when ordered.
- Custom products: A 50% deposit is due when the order is placed. The remaining balance is due when the product is ready for shipment or installation and must be paid before release, shipment, or installation.
Where permitted and authorized, Abby Iron Doors may charge the remaining balance to the payment method used for the deposit when payment becomes due.
Customers are responsible for applicable taxes, freight, storage, permit, inspection, redelivery, and other charges not expressly included in writing.
4. Shipping, Delivery & Inspection
Unless Abby Iron Doors is providing installation or otherwise agrees in writing, delivery is generally curbside, and the customer is responsible for adequate personnel and equipment to unload the goods.
Customers must inspect goods at delivery. Visible damage or shortages must be noted on the carrier’s delivery receipt before signing.
All damage or shortage claims must be submitted to Abby Iron Doors in writing with supporting photographs within three (3) calendar days of delivery. Failure to provide timely notice may constitute acceptance of the goods and may affect freight, insurance, or warranty claims.
Estimated production, shipping, and delivery dates are not guaranteed. Abby Iron Doors is not responsible for delays outside its reasonable control.
Completed goods may be stored for 30 days at no charge. Thereafter, storage fees of $40 per package per month may apply for up to six months. Failure to pay amounts due or take delivery may result in forfeiture or cancellation as permitted by the applicable agreement and law.
5. Returns & Cancellations
In-Stock Products: Eligible returns must be requested within seven (7) days of receipt and are subject to Abby Iron Doors’ approval and a 30% restocking fee. Original shipping is non-refundable, and the customer is responsible for return freight, packaging, crating, and related costs.
An in-stock order may generally be canceled without penalty within seven days of purchase if it has not shipped.
Custom Products: Once fabrication begins, custom products are non-cancelable and non-refundable.
If Abby Iron Doors voluntarily agrees to accept a custom return, the product must be returned in its original condition and inspected before any refund is issued. The customer is responsible for all return costs.
6. Installation, Measurements & Repairs
Installation includes only the work specifically identified in the customer’s written agreement. Work not expressly included is the customer’s responsibility.
Measurement responsibility is determined by the applicable order or installation agreement. When a customer, contractor, architect, builder, or other third party supplies measurements, Abby Iron Doors is not responsible for errors resulting from those measurements unless Abby Iron Doors expressly assumes measurement responsibility in writing.
For damaged or defective goods, Abby Iron Doors may determine the appropriate remedy, including repair, refinishing, component replacement, or product replacement.
Customers may not authorize repairs or incur expenses on behalf of Abby Iron Doors without prior written approval. Unauthorized repair costs are the customer’s responsibility.
Abby Iron Doors may use subcontractors, installers, carriers, suppliers, or other third parties to perform services or remedies.
7. Building Codes & Project Requirements
Building-code, permit, wind-load, impact, egress, structural, and other requirements vary by jurisdiction.
Unless expressly agreed otherwise in writing, outside the Metro Atlanta area, the customer is responsible for confirming that the selected products comply with applicable local codes and project requirements.
Customers should consult their contractor, architect, engineer, or building department where necessary.
For balconies, railings, guards, and similar products, the customer is responsible for proper structural support, fastening, anchoring, load requirements, and code compliance unless Abby Iron Doors expressly assumes such responsibility in writing.
8. Limited Warranty
Warranty coverage begins only after the applicable order has been paid in full.
Subject to the complete warranty terms and exclusions:
- Factory-applied finish: 2 years from delivery against defects in material and workmanship.
- Structural components: 15 years from delivery against qualifying manufacturing defects.
- Glass components: 1 year from delivery against manufacturer defects only.
Normal aging, weathering, fading, oxidation, patina, environmental exposure, wear items, glass breakage, misuse, abuse, improper installation or maintenance, unauthorized repair or modification, pressure washing, structural movement, moisture, salt air, flooding, fire, vandalism, third-party damage, and circumstances outside Abby Iron Doors’ control are not covered.
Customers must provide reasonable notice, documentation, photographs when requested, and access for inspection or repair.
For a covered claim, Abby Iron Doors may, at its discretion, repair, refinish, replace a component, or replace the affected product.
Except for warranties expressly provided in writing, Abby Iron Doors disclaims other express, implied, and statutory warranties, including warranties of merchantability and fitness for a particular purpose, to the maximum extent permitted by law.
9. Limitation of Liability
To the maximum extent permitted by law, Abby Iron Doors is not liable for indirect, incidental, special, punitive, or consequential damages, including lost profits, loss of use, diminution in property value, or other economic losses arising from products, services, delays, installation, warranty claims, or use of the website.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
10. Indemnification
To the extent permitted by law, each party agrees to indemnify and hold the other party and its officers, employees, agents, and subcontractors harmless from claims, losses, damages, liabilities, costs, and reasonable attorneys’ fees to the extent caused by that party’s negligence, misconduct, violation of law, or breach of these Terms.
11. Arbitration & Georgia Law
To the extent permitted by law, disputes arising from these Terms or transactions with Abby Iron Doors shall be resolved through binding arbitration before an arbitrator located in the county where Abby Iron Doors is based, under applicable American Arbitration Association rules.
The arbitrator’s decision shall be final and binding and may be enforced in a court of competent jurisdiction.
Where permitted, a prevailing party may recover reasonable attorneys’ fees and enforcement costs when the other party refuses required arbitration, unsuccessfully challenges an award, or refuses to comply with it.
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Matters properly brought in court shall be brought in the appropriate state or federal court in Georgia.
12. Intellectual Property & Third-Party Services
All website content, including Abby Iron Doors’ photographs, designs, drawings, logos, text, graphics, videos, and other materials, is owned by or licensed to Abby Iron Doors and may not be copied, distributed, modified, or commercially used without written permission.
Our website may link to third-party websites or services. Abby Iron Doors is not responsible for third-party content, security, availability, terms, or privacy practices.
13. Privacy & Electronic Communications
Your use of the website is also subject to our Privacy Policy.
By communicating electronically with Abby Iron Doors, you agree that quotes, invoices, drawings, order confirmations, payment notices, production updates, shipping notices, and other communications may be provided electronically where permitted by law.
14. General Terms
Abby Iron Doors is not responsible for delays or failures caused by circumstances beyond its reasonable control, including severe weather, natural disasters, government actions, transportation disruptions, labor disputes, supplier shortages, manufacturing interruptions, or other events beyond our control.
If any provision of these Terms is found unenforceable, the remaining provisions remain effective. Failure to enforce a provision does not waive it.
We may update these Terms periodically. Changes apply prospectively unless otherwise required by law.
These Terms, together with the applicable Privacy Policy and any quote, order agreement, sales contract, invoice, installation agreement, or warranty, constitute the applicable agreement between the parties. A more specific signed agreement controls over these general website Terms in the event of a conflict.
